MBNA loses PPI court case

A decision by a county court judge could mean thousands of borrowers being able to renege on their debts.

Judge Jacqueline Smart at South Shields county court has decided that the MBNA credit card company cannot demand the repayment of a customer’s debt.

It tried to force Mrs Lynne Thorius to repay the £8,000 she owed on her card.

But the Judge decided there had been an unfair relationship between Mrs Thorius and MBNA because of the way she had been sold payment protection insurance.

Will I have to pay anything to your solicitor?

No arrangements will already be in place to ensure you will have no costs to pay.

Will I have to attend court?

We would anticipate that most lenders will be sensible and will not dispute our solicitors findings when they present them with the evidence that the agreement contains breaches and is therefore unenforceable. However in the unlikely event that that it becomes necessary for you to attend court you will be accompanied by one of our experienced solicitors who will guide you every step of the way.

Do I have any alternatives other than making a claim in this way?

Yes, you could make a claim through the Financial Ombudsman or seek assistance from organisations such as The Citizens Advice Bureau or National Debtline.

Will I be able to obtain another credit card or loan?

There is no reason why not there is nothing we do during our process which should affect your ability to obtain a loan or credit card from a different lender.

Can I keep using my credit card?
